Generally, the Foreign Corrupt Practices Act (“FCPA”) prohibits payments to foreign officials to facilitate business in the official’s jurisdiction; however, the FCPA allows payments to foreign government officials for “routine government action” which the official is “required” to provide, where no discretion, other than the timing of the performance, is involved.
